Starting from May 12th, the classification and transportation management regulations previously issued by the General Administration of Customs regarding the import of solid waste will be abolished.

 General Administration of Customs Announcement No. 21 of 2010 (Regarding the Implementation of Classification-Based Loading Management for Key Solid Wastes) In order to strengthen the management of imported solid wastes and crack down on smuggling activities conducted through the channels of imported solid wastes, to maintain the normal trade order of solid waste imports, in accordance with the "Customs Law of the People's Republic of China", "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and other laws and regulations, after consultation with the Ministry of Commerce, the Ministry of Environmental Protection, and the General Administration of Quality Supervision, Inspection and Quarantine, it is decided to implement classification-based loading management for the import of scrap metals, waste plastics, and waste paper (hereinafter referred to as "key solid wastes"). The relevant matters are hereby announced as follows: 1. Key solid wastes shall not be mixed with other non-key solid wastes and goods that are not solid wastes when loaded in the same container.

2. For imported key solid wastes loaded in containers, they should be classified in accordance with the classification requirements in the attached "Classification Table of Key Solid Wastes" of this announcement. The A-K category key solid wastes should be separately loaded. Simple pre-loading treatments such as strapping, bundling, and packaging should be carried out, and each item should be declared in accordance with the requirements of standardized declaration. If the weight of other category key solid wastes mixed in the container accounts for 2% or less of the total cargo loading capacity of the container, it shall not be regarded as mixed loading.
3. Substandard and substandard products of imported ordinary goods must be declared as ordinary goods and shall not be declared as solid wastes. For imported solid waste processing management parks (hereinafter referred to as "parks") that have passed the acceptance by relevant state departments and have the conditions for customs supervision, after approval by the directly affiliated customs of the park's location and the General Administration of Customs, enterprises within the park can conduct destructive processing of the above-mentioned goods within the park and declare them as solid wastes in accordance with the requirements of standardized declaration.
4. Due to special reasons, if the classification loading requirements in the attached "Classification Table of Key Solid Wastes" cannot be met and the key solid wastes are directly transported to the country without changing transportation means abroad, the importing enterprise shall submit an application to the directly affiliated customs at the port of departure before loading. The directly affiliated customs shall report to the General Administration of Customs for approval, and then the above-mentioned imported key solid wastes must be sorted by category at the port site or in the park with the conditions for customs supervision, and declared item by item in accordance with the requirements of standardized declaration.
5. For two or more (including two) different categories of key solid wastes that are transported in bulk and arrive at the country, after customs supervision, they must be sorted by category at the port site or in the park with the conditions for customs supervision, and declared item by item in accordance with the requirements of standardized declaration.
6. With the approval of the directly affiliated customs of the park's location by the General Administration of Customs, enterprises within the park are allowed to sort the mixed key solid wastes of different categories by category within the park and declare them as solid wastes in accordance with the requirements of standardized declaration based on the sorted status.
7. For key solid wastes that do not meet the above regulations and have no suspicion of smuggling or violation of customs supervision regulations, the importing enterprise may apply for direct return procedures.
8. This announcement shall come into effect on June 1, 2010.
